We work exclusively on the basis of the latest version of the German Freight Forwarders Standard Terms and Conditions(ADSp).
According to Clause 23 of the ADSp, the statutory liability for cargo damage under §431 of the German Commercial Code (HGB) is limited to EUR 5.00/kg for damages that occur while the goods are in the custody of the freight forwarder; for multimodal transports including sea carriage, the liability is limited to 2 SDR (Special Drawing Rights)/kg. Additionally, the liability is limited to either EUR 1 million or 2 SDR/kg per damage event, depending on which amount is higher.
Clause 27 of the ADSp does not apply to transports subject to the Montreal Convention. Therefore, Clause 27 of the ADSp is not considered an agreement for alternative liability limits within the meaning of Article 25 of the Montreal Convention.
